PUBLIC AGREEMENT (OFFER)

for the purchase and sale of auto parts

This Agreement is an official public offer (offer) of the Seller, addressed to an indefinite circle of persons, to conclude a contract for the sale of goods by remote means in accordance with Articles 633, 641, 642 of the Civil Code of Ukraine and the Law of Ukraine “On Electronic Commerce.”

1. General

1.1. This Agreement sets out the terms and conditions for the sale of new and used auto parts through the Seller's online store.

1.2. By placing an Order, the Buyer fully and unconditionally accepts the terms and conditions of this Agreement (acceptance).

1.3. The Seller reserves the right to make changes to this Agreement without prior notice to the Buyer.

2. Terms and definitions

  • Seller — a person who sells goods through the website.
  • Buyer — an individual or legal entity that places an order.
  • Goods — new or used auto parts presented on the website.
  • Order — a duly completed request by the Buyer to purchase goods.
  • Offer — this public proposal to conclude an agreement.

3. Subject matter of the agreement

3.1. The Seller undertakes to transfer ownership of the auto parts to the Buyer, and the Buyer undertakes to accept and pay for them under the terms of this Agreement.

3.2. The range, prices, and characteristics of the goods are indicated on the website and are subject to change without notice.

4. Placing an order

4.1. Orders are placed via the website or with the help of a manager.

4.2. The Buyer undertakes to provide accurate contact details.

4.3. The Seller has the right to refuse to fulfill an order if the goods are out of stock or cannot be shipped.

5. Price and payment

5.1. Prices for goods are indicated in hryvnia.

5.2. Payment is made in one of the following ways:

  • cash on delivery (cash on delivery);
  • payment to the Seller's bank account. 5.3. For orders over 1000 UAH, prepayment may be required. 5.4. Delivery costs are paid separately by the Buyer.

6. Delivery of goods

6.1. Delivery is carried out by the Nova Poshta service throughout Ukraine.

6.2. Self-delivery from the warehouse is also possible by prior agreement.

6.3. The risk of accidental damage or loss of goods passes to the Buyer from the moment the goods are transferred to the delivery service or upon self-delivery.

7. Warranty and quality of goods

7.1. New and used auto parts are covered by a 5-day warranty for inspection and installation.

7.2. The warranty takes effect from the moment the goods are received by the Buyer.

7.3. Used goods may show signs of wear, which is not a defect.

7.4. The warranty does not cover the paintwork of used parts.

8. Exchange and return

8.1. Exchange or return is possible in the following cases:

  • discovery of significant defects;
  • discrepancy between the condition of the goods and the description;
  • incorrect shipment of goods;
  • under previously agreed conditions.

8.2. The following items are not returnable:

  • goods damaged after receipt;
  • engines, automatic transmissions, sidewalls;
  • electrical equipment with a different number than in the order.

8.3. In case of return, only the cost of the goods is reimbursed, delivery is paid by the Buyer.

9. Rights and obligations of the parties

9.1. The Seller undertakes to provide accurate information about the goods.

9.2. The Buyer undertakes to familiarize themselves with the characteristics of the goods before purchasing.

9.3. The Buyer has the right to receive advice on the condition of the goods before placing an order.

10. Liability of the parties

10.1. The parties are liable in accordance with the current legislation of Ukraine.

10.2. The Seller is not liable for incorrect installation or use of the goods.

11. Confidentiality

11.1. The Buyer's personal data is processed in accordance with the Law of Ukraine “On the Protection of Personal Data.”

11.2. The data is used exclusively for order processing.

12. Final provisions

12.1. The contract is valid from the moment of acceptance by the Buyer.

12.2. All disputes shall be resolved through negotiations, and if this is not possible, in court in accordance with the legislation of Ukraine.
